By accessing our website, placing an order, or utilizing our products, you agree to be bound by these Policies & Terms. Senior Selections reserves the right to amend these terms at its discretion without prior notice. It is your responsibility to review this page periodically for updates. Use of our services constitutes acceptance of the current Policies & Terms.
1. Orders & Product Specifications
- Order Processing: All orders are subject to review and approval by Senior Selections. We reserve the right to accept, decline, or cancel any order at our sole discretion, including, but not limited to, instances of product unavailability, pricing discrepancies, or suspected fraudulent activity. Affected customers will be notified promptly.
- Product Descriptions: Senior Selections endeavors to ensure product descriptions are accurate; however, we do not warrant that specifications, images, or details are free from errors or omissions. Minor variations may occur, and we bear no liability for such discrepancies.
- Availability: Products are offered subject to availability. In the event of an out-of-stock item, Senior Selections may, at its discretion, provide a comparable substitute or issue a refund.
2. Pricing & Payment Terms
- Pricing Policy: Prices are subject to change without prior notice. Senior Selections reserves the right to correct pricing errors and may cancel orders affected by such inaccuracies at its discretion.
- Taxes & Additional Fees: Customers are responsible for all applicable sales taxes, duties, or fees imposed by law or added during checkout, unless expressly stated otherwise.
- Payment Requirements: Payment must be made using the authorized methods specified at checkout. Senior Selections may cancel orders if payment is declined or fails to clear, without incurring liability.
3. Shipping & Delivery
- Delivery Conditions: Shipments are made exclusively to long-term care facilities, contingent upon their acceptance policies. Customers must verify facility regulations; Senior Selections is not liable for delays, refusals, or losses resulting from facility procedures.
- Delivery Estimates: Shipping timelines are provided as approximations only. Senior Selections is not responsible for delays caused by carriers, weather, or other external factors beyond our control.
- Transfer of Risk: Ownership and risk of loss transfer to the customer upon handover to the shipping carrier. Inquiries regarding lost or damaged shipments should be directed to the receiving facility.
4. Returns & Refunds
- Return Policy: Given the specialized nature of our products and clientele, all sales are final unless Senior Selections authorizes an exception. Requests for returns must be submitted to info@seniorselections.shop within seven (7) days of delivery and will be evaluated at our sole discretion.
- Return Eligibility: Approved returns require items to be unused, unopened, and in their original packaging. Customers are responsible for return shipping costs unless the error is attributable to Senior Selections (e.g., incorrect item shipped).
- Refund Process: If a refund is approved, Senior Selections will process it in a manner and timeframe of our choosing, via the original payment method or as store credit. Shipping fees are non-refundable.
5. Liability & Product Use
- Customer Responsibility: Products are provided "as-is." Senior Selections assumes no liability for misuse, improper storage, or any resulting injuries, damages, or health-related issues post-delivery. Customers are advised to consult healthcare professionals prior to use.
- Warranty Disclaimer: Senior Selections disclaims all express or implied warranties, including fitness for a particular purpose. Defective products may be replaced at our discretion, constituting the extent of our obligation.
- Limitation of Liability: In any event, Senior Selections’ liability shall not exceed the purchase price of the product. We are not responsible for consequential, indirect, or incidental damages, including but not limited to medical expenses or emotional distress.
6. Customer Obligations
- Accuracy of Information: Customers must provide accurate order details, including delivery addresses and payment information. Senior Selections is not liable for errors stemming from customer-provided data.
- Conduct: Senior Selections reserves the right to terminate service to any individual engaging in abusive behavior, site misuse, or violation of these terms.
7. Privacy
- Personal information is collected and processed solely to facilitate orders and business operations. Senior Selections is not liable for security breaches beyond our reasonable control.
8. Dispute Resolution
- Governing Law: These Policies & Terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes shall be resolved exclusively in the state or federal courts of Massachusetts.
- Individual Claims: Customers agree to pursue claims against Senior Selections on an individual basis only, waiving any right to participate in class actions.
- Statute of Limitations: Legal claims must be initiated within six (6) months of the incident, or they are permanently barred.
- Force Majeure: Senior Selections is not liable for delays or failures due to unforeseen events such as natural disasters, pandemics, supply chain disruptions, or governmental actions. Affected orders will be addressed at our discretion, with no obligation to refund.
